These Terms and Conditions ("Terms") govern your use of the website **tuktuk.gr** and the purchase of tour services offered by **Tuk Tuk Kreta Tours** ("we," "us," "our," or "the Company").

By booking a tour or using our website, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our services.

## 2. Services

Tuk Tuk Kreta Tours organises and operates guided tours, excursions, and activities in Crete, Greece. All tours are subject to availability and operate in accordance with Greek law and the conditions set by the Greek National Tourism Organisation (EOT).

## 3. Bookings

### 3.1 How to Book

Bookings can be made online via our website, by phone, or by email. A booking is confirmed only upon receipt of our written confirmation (email) and payment of the required deposit or full amount.

### 3.2 Booking Confirmation

You will receive an instant confirmation email after completing your booking. Please check all details carefully. If any information is incorrect, contact us immediately at info@tuktuk.gr.

### 3.3 Group Size

Minimum and maximum participant numbers apply to certain tours. We reserve the right to cancel or combine tours if minimum numbers are not reached. In this case, you will be offered an alternative date or a full refund.

### 3.4 Age and Health Requirements

Some tours have minimum age or fitness requirements. These are specified on each tour page. By booking, you confirm that all participants meet the stated requirements. We reserve the right to exclude participants who do not meet the requirements, without obligation to provide a refund.

## 4. Prices and Payment

### 4.1 Pricing

All prices are quoted in **Euro (EUR)** and include VAT where applicable. Prices on the website are per person unless otherwise stated.

### 4.2 Payment

Full payment is required at the time of booking unless a deposit option is specified. We accept major credit and debit cards. Payment processing is handled by a secure third-party payment provider. We do not store your card details.

### 4.3 Price Changes

We reserve the right to correct pricing errors. If a pricing error is identified after booking, we will notify you and offer the option to proceed at the correct price or receive a full refund.

## 5. Cancellation and Refund Policy

Cancellations must be submitted in writing via email to info@tuktuk.gr. The cancellation date is the date we receive your written notification.

### 5.2 Cancellations by Tuk Tuk Kreta Tours

We reserve the right to cancel tours due to:

- Unsafe weather conditions

- Insufficient participants

- Force majeure (strikes, natural disasters, government restrictions, etc.)

- Any other circumstances beyond our reasonable control

In the event of cancellation by us, you will receive a **full refund** or be offered an alternative tour date. We are not liable for any additional costs incurred (e.g. travel, accommodation).

### 5.3 Tour Modifications

We reserve the right to modify tour itineraries, routes, or activities where necessary for safety reasons or circumstances beyond our control, without obligation to provide a refund.

## 6. Participant Responsibilities

### 6.1 Conduct

All participants are expected to behave in a respectful and responsible manner towards our staff, guides, other participants, and local communities. We reserve the right to exclude any participant who endangers others, acts disruptively, or fails to follow guide instructions. No refund will be provided in such cases.

### 6.2 Punctuality

Participants must arrive at the meeting point at the specified time. Late arrivals may not be accommodated and no refund will be provided for missed departures due to the participant's tardiness.

### 6.3 Personal Belongings

We are not responsible for loss, theft, or damage to personal belongings during any tour or activity.

### 6.4 Medical Conditions

It is your responsibility to inform us of any medical conditions, allergies, or special needs at the time of booking that may affect participation. We will do our best to accommodate reasonable requests but cannot guarantee this for all tours.

## 7. Health, Safety and Insurance

### 7.1 Safety

The safety of our participants is our top priority. All tours are conducted in accordance with Greek safety regulations. Our guides are trained and experienced. Participants must follow all safety instructions given by guides at all times.

### 7.2 Personal Insurance

We strongly recommend that all participants have adequate **travel insurance** covering medical expenses, personal accidents, cancellation, and curtailment. Tuk Tuk Kreta Tours does not provide personal travel insurance.

### 7.3 Liability

To the maximum extent permitted by Greek law, Tuk Tuk Kreta Tours shall not be liable for:

- Personal injury, illness, or death unless caused by our proven negligence

- Loss or damage to personal property

- Indirect or consequential losses

- Losses arising from events outside our reasonable control (force majeure)

## 8. Photographs and Media

Our guides or company representatives may take photographs or video during tours for promotional and marketing purposes. By participating in a tour, you consent to being photographed or filmed. If you do not wish to be photographed, please notify your guide before the tour begins.

## 9. Intellectual Property

All content on the tuktuk.gr website — including text, images, videos, logos, and software — is the property of Tuk Tuk Kreta Tours or its licensors and is protected by Greek and EU copyright law. You may not reproduce, distribute, or use any content without our prior written permission.

## 10. Privacy

Your personal data is processed in accordance with our **Privacy Policy**, which is available on our website. By using our services, you consent to the collection and use of your data as described in the Privacy Policy.

## 11. Complaints

If you have a complaint during a tour, please raise it immediately with your guide or our staff so that we have the opportunity to resolve it on the spot. If the issue is not resolved satisfactorily, submit a written complaint to info@tuktuk.gr within **14 days** of the end of the tour. We will acknowledge your complaint within 3 business days and aim to respond fully within 14 business days.

## 12. Governing Law and Jurisdiction

These Terms are governed by the laws of **Greece**. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of **Heraklion, Crete, Greece**.

## 13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
